About these terms
This website at digisys.com.au and the Customer Portal are operated by Digital Systems Aus Pty Ltd ("DigiSys", "we", "us"). By using the site or the portal, you agree to these terms.
If we've entered into a service agreement or accepted proposal with you, that document governs the services we provide, and prevails over these terms to the extent of any inconsistency.
Information on this site
The content on this site is general information about our business and services. It isn't professional, technical or legal advice for your specific situation — talk to us before relying on it for a decision.
We work to keep the site accurate and current, but we don't guarantee it's complete or error-free at every moment, and we may change content at any time.
Our services
We provide technology services including AI solutions, business process automation, online presence services, cybersecurity (including our PenShield penetration-testing subscription), and managed web hosting. Specific inclusions, terms and pricing for any service are set out in your quote, proposal or service agreement.
Where the Australian Consumer Law applies, our services come with guarantees that cannot be excluded — including that services will be provided with due care and skill, be fit for the purpose you told us about, and be supplied within a reasonable time.
Quotes, invoices and payment
Our pricing is by tailored quote or subscription, as described in your proposal. Quotes are valid for the period stated on them, and work begins once you've accepted in writing.
Invoices are issued electronically through our accounting platform (Xero) and are payable by the due date shown. Card payments made through the Customer Portal are processed securely by Stripe — we don't store your full card details.
Customer Portal
The Customer Portal lets you view your services and licences, see and download invoices, and pay online. Your account is for your business's use:
- Keep your sign-in credentials confidential and let us know immediately if you suspect unauthorised access.
- Make sure the account and contact information you give us is accurate and kept up to date.
- You're responsible for actions taken under your account, unless caused by our failure to secure the portal.
- We may suspend portal access to protect security, investigate misuse or where required by law — we'll tell you unless the law prevents it.
Acceptable use
When using our website, portal or hosted services, you must not:
- Break the law, or infringe anyone's rights.
- Attempt to gain unauthorised access to our systems or anyone else's, or test our security without our prior written consent.
- Introduce malware or interfere with the operation of the site, the portal or our infrastructure.
- Use automated scraping or bulk data extraction against the site or portal.
- Use hosted services to send spam or host unlawful content.
Intellectual property
The content of this site — text, graphics, logos and the DigiSys brand — is owned by or licensed to us. You may view and share it for ordinary business purposes, but you can't republish or commercially exploit it without our permission.
Materials you provide to us remain yours. Ownership of deliverables we create for you (such as websites, workflows or reports) is dealt with in your service agreement.
Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other law that cannot be excluded, restricted or modified by agreement.
To the extent the law (including the Australian Consumer Law) permits, our liability for a failure connected with services we supply is limited to resupplying the services or paying the cost of having them resupplied, and we are not liable for indirect or consequential loss.
Third-party platforms we integrate with or resell — for example Microsoft 365, HubSpot, Stripe and Xero — have their own terms, and we aren't responsible for those platforms' own failures, though we'll always help you deal with them.
Links to other sites
Our site may link to third-party websites for your convenience. We don't control them and linking isn't an endorsement — their content and terms are their own responsibility.
General
We may update these terms from time to time by publishing the new version on this page; the changes apply from publication.
If part of these terms turns out to be unenforceable, the rest still applies.
These terms are governed by the laws in force in Australia, including the laws of the state or territory in which Digital Systems Aus Pty Ltd is registered, and the courts of that jurisdiction. Questions about these terms can be sent to admin@digisys.com.au.
